Terms of Service

These Terms of Service (“Terms”) govern your use of SpinSend, a promo delivery service provided by AF Studios (“AF Studios”, “we”, “us”). By using SpinSend you agree to these Terms.

1. The service

SpinSend lets record labels upload releases and share private links so DJs and other recipients can stream, download and give feedback on promotional music. Some features are marked “coming soon” and are not yet available.

2. Accounts

Label workspaces are currently provided by invitation. You are responsible for keeping your login details secure and for activity in your workspace. You must give accurate information and be at least 18 years old, or the age of majority where you live.

3. Your content and ownership

Labels keep all ownership of the audio, artwork and other content they upload (“Label Content”). Uploading does not transfer any rights to AF Studios. You grant us a limited, non-exclusive licence to store, process, transcode, stream and deliver Label Content solely to operate SpinSend for you. You confirm you have the rights needed to upload and distribute Label Content to your recipients.

4. Recipients

Promo links are personal and for the recipient’s own evaluation and use as permitted by the label. Recipients must not share links or redistribute content without the label’s permission. Labels may revoke links or set expiry dates at any time.

5. Acceptable use

You must not use SpinSend to upload content you don’t have rights to, send spam, attempt to access other labels’ data, interfere with the service, or break the law. We may suspend accounts that do.

6. Data and analytics

SpinSend records promo activity (such as plays and downloads) and recipient feedback and shows it to the label that sent the promo. Our Privacy Policy explains how we handle personal information. Labels are responsible for having a lawful basis to add recipients’ details.

7. Plans, fees and payment

Plans and prices (in USD) are listed on our pricing page and may change with notice. When online billing launches, AF Studios will bill labels for SpinSend subscriptions and packs through Stripe, our payment processor, subject to Stripe’s terms. SpinSend does not process or facilitate payments between labels, DJs or other recipients. Unless stated otherwise, fees are non-refundable except where required by law.

8. Availability and changes

We aim to keep SpinSend available and reliable but do not guarantee uninterrupted service. We may change, add or remove features. We recommend you keep your own copies of all Label Content.

9. Termination

You may stop using SpinSend at any time. We may suspend or end access for breach of these Terms. After termination we may delete Label Content after a reasonable period.

10. Disclaimers

SpinSend is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, AF Studios will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms and will change the date above. Continued use after changes means you accept them.
